Siapa “pekerja” (employee)?

Pekerja ialah mana-mana individu yang telah memasuki kontrak perkhidmatan dengan mana-mana majikan tanpa mengira tahap upah atau jenis pekerjaan (Pindaan baru), ataupun mana-mana individu yang Menteri Sumber Manusia membuat perintah.

Sebelum ini, Akta Kerja 1955 tidak melindungi pekerja bukan manual yang berpendapatan melebihi RM2,000 dengan beberapa pengecualian. Syarat-syarat kerja bagi pekerja bukan manual yang berpendapatan melebihi RM2,000 bergantung kepada kontrak perkhidmatan sahaja.

Rang Undang-Undang Kerja (pindaan) 2022 telah menghapuskan had upah RM2,000 yang tidak munasabah. Selepas pindaan, semua pekerja manual dan bukan manual tanpa mengira tahap gaji akan dilindungi di bawah Akta Kerja 1955.

Walaubagaimanapun, hak ke atas OT hanya diberikan kepada pekerja manual tanpa mengira tahap gaji mereka. Bagi pekerja bukan manual, hanya mereka berpedapatan di bawah RM4000 berhak kepada OT.

Who is an employee?

An employee is any individual who has entered into a contract of service with any employer regardless of the level of wages or type of employment (New Amendment), or any individual whom the Minister of Human Resources has made an order.

Previously, the Employment Act 1955 did not protect non-manual workers earning more than RM2,000 with some exceptions. The working conditions for non-manual workers earning more than RM2,000 depend on the contract of service only.

The Employment (Amendment) Bill 2022 has removed the unreasonable wage limit of RM2,000. After the amendment, all manual and non-manual workers regardless of their salary level will be protected under the Employment Act 1955.

However, the right to Overtime (OT) is only given to manual workers regardless of their salary level. For non-manual workers, only those earning below RM4000 are entitled to OT.
